These terms explain how you may use our website, what our online content is and isn’t, and the basics of requesting care from Rise Up Counseling.

These Terms & Conditions (“Terms”) govern your use of the Rise Up Counseling website at riseupcounseling.net (the “Website”), including its pages, forms, resources and podcast content. By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
The Website, our forms, email, text messaging and voicemail are not monitored for emergencies and are not a substitute for emergency care.
If you or someone else is in immediate danger, call 911 or go to the nearest emergency room. For a mental health or substance use crisis, call or text 988 to reach the Suicide & Crisis Lifeline. Veterans can dial 988 and press 1.
Content on the Website, including articles, resource lists, FAQs and The Rise Up Sessions podcast, is provided for general educational and informational purposes. It is not medical, psychological or legal advice and is not a substitute for an individual assessment, diagnosis or treatment by a qualified professional.
We work to keep information accurate and current, but services, clinician availability, insurance participation, fees and resource details can change without notice.
Using the Website, submitting a form, sending an email or text, or listening to our podcast does not create a therapist–client or provider–patient relationship. That relationship begins only after intake is completed and both you and Rise Up Counseling agree to begin services.
Submitting an appointment request does not guarantee an appointment, a specific clinician, a specific location or a specific time. Clinician availability, specialties and insurance participation vary and change over time. After reviewing your request, we may recommend a different clinician, service or level of care, or refer you to another provider if that would better meet your needs.
You agree to provide accurate, current and complete information and to submit requests only for yourself or for someone you are legally authorized to act for, such as your minor child.
Telehealth services are available to clients who are physically located in New Jersey at the time of each session, unless otherwise permitted by law. You are responsible for a reliable internet connection, a suitable device, and a private location for your sessions. Telehealth has limitations, and your clinician may recommend in-person care when it would be more appropriate.
Extended sessions, intensives, workshops, executive therapy and between-session support are offered based on clinical fit and availability. Specific terms, such as minimum hours, scheduling, payment arrangements and the boundaries of any text or email support, are explained before enrollment. Between-session support is not for emergencies or crisis response.
Rise Up Counseling and Rise Integrative Health provide independent clinical evaluations and documentation. A nexus letter or other supporting documentation is prepared only when the clinical findings support it.
We do not decide VA or other benefit claims, and we cannot guarantee any disability rating, claim outcome or decision by a third party. Our services do not replace legal advice from an accredited veterans representative or attorney. Fees for assessments and documentation are for the professional services provided, not for any particular result.
Medication and lifestyle management, ADHD assessments and certain medical evaluations are provided in cooperation with Rise Integrative Health, including care provided by Dr. Anmol Khadtale, DO. Rise Integrative Health is responsible for the medical care it provides, and its own policies, fees and insurance participation may apply.
The Rise Up Sessions podcast and other educational content reflect general perspectives and real-life stories. Views expressed by guests are their own. Listening to or watching our content is not therapy and should not be relied on as a substitute for individualized care.
The Website links to third-party websites and services, such as crisis lines, mental health organizations, Google Maps, Spotify and YouTube. We provide these links for convenience and do not control or endorse their content, availability or privacy practices. Your use of third-party sites is at your own risk and subject to their terms.
The Website and its content, including text, graphics, logos, images, podcast materials and design, are owned by or licensed to Rise Up Counseling and are protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, republish or use our content or branding for commercial purposes without our written permission.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, RISE UP COUNSELING AND ITS OWNERS, CLINICIANS, STAFF AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, OR ANY OBLIGATIONS WE OWE YOU AS A CLIENT UNDER PROFESSIONAL STANDARDS OR LAW.
To the extent permitted by law, you agree to indemnify and hold harmless Rise Up Counseling and its owners, clinicians and staff from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Website or your violation of these Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute relating to the Website or these Terms will be brought in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts. If any part of these Terms is found unenforceable, the remaining parts will remain in effect.
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of the Website after an update means you accept the updated Terms.
